Our Terms

The Terms regarding the services provided by GoBuddy in Portugal apply to the site and mobile application.

1. Scope and Object

These General Conditions apply to visitors, couriers or partners of this website (hereinafter “Users” and/or “User”) and are intended to regulate the terms and conditions under which the provision of the delivery solution service with greater convenience for everyday life (“Service”) will be provided by Buddy, Sociedade Unipessoal, Ldawith registered office at Rua do Bolhão nº85, 1ºE, Porto 4000-230, under the single registration and taxpayer number 516331094, hereinafter referred to as “GOBUDDY”.

The Service consists of the availability, through the app that, in addition to providing information on a set of products and/or services, allows the User, electronically, to order the products advertised in it, under the terms and conditions described herein.

Product orders must be placed by Users aged 18 (eighteen) or over (individuals under this age must have the authorisation of their legal representatives). The elements and information transmitted by the User shall enjoy full legal effect, recognising the User’s electronic purchases, and the User cannot allege the lack of signature for breach of obligations assumed.

Browsing the website, as well as purchasing any product in the online shop, implies the User’s acceptance of these General Conditions.

GOBUDDY reserves the right to amend these General Conditions without prior notice, any changes being published on www.gobuddyapp.com.

2. Information on Products, Prices, Invoicing and Payment

2.1 Products
GOBUDDY takes into consideration information relating to the essential characteristics of the products by means of technical descriptions shared by its suppliers or third parties, photographs and videos illustrating the products sold, in strict compliance with the best market standards, transmitting this information clearly to its customers on the page of each product, shop, restaurant and/or service it offers.

GOBUDDY will make every effort to ensure that the information presented is free from typographical errors and will be rapidly corrected whenever they occur. If you purchase a product that has different characteristics to those shown online, you are entitled to withdraw from the purchase contract under the terms of the applicable law.

GOBUDDY will make every effort to deliver all the products ordered but it is possible that in certain cases and due to causes beyond GOBUDDY, control, such as human error or computer system incidents, it may not be possible to deliver any of the products requested by the User. If any product is not available after you have placed your order, you will be notified by notification on the app. At that moment you will be presented with the possibility of requesting cancellation of the order, with the respective refund, if you have already made the respective payment. However, for other reasons, which GOBUDDY will review at a later date, the customer will have 12 hours to communicate their interest in purchasing a refund.

All information on prices, products, specifications, promotional activities and services may be changed at any time by GOBUDDY.

2.2 Prices, Invoicing and Payment
GOBUDDY provides in its app, in a clear manner, the total price of each good or service, including fees and taxes, additional transport charges, postal or delivery charges or any other charges that may be applicable.

GOBUDDY cannot be held responsible in the event of a computer, manual, technical or any other error causing an unforeseen substantial alteration to the retail price shown in its app, whereby in cases where this is exorbitant or manifestly derisory, the purchase order shall be considered invalid and cancelled and the Customer shall be informed accordingly.

The prices and products available on the app, as well as promotional campaigns and offers, are only valid for purchases made through the app, and may not coincide with those practiced in physical shops, unless promotions are expressly indicated on the online page.

The retail prices indicated in this app are in euros. VAT and other legally applicable taxes or fees are included in all prices.

2.3 Payment Methods
For the User’s convenience, GOBUDDY provides the following means of payment for products and/or services on the website:

  • Card Visa, MasterCard ou American Express;
  • Maestro

3. Responsibilities

All products and services commercialized on this platform are in accordance with Portuguese Law.

The Platform has adequate levels of security, however GOBUDDY shall not be liable for any losses incurred by the User and/or third parties as a result of delays, interruptions, errors and suspensions of communications originating from factors beyond its control, notably any shortcomings or failures caused by the communications network or communications services provided by third parties, the computer system, modems, connection software or any computer viruses or arising from the downloading (“download”) via the service of files infected with or containing viruses or other properties that may affect the User’s equipment. If it is impossible to provide the service due to an error in accessing the electronic site of the platform, GOBUDDY nshall not be responsible for any possible damages.

Requests for data and information within the scope of this Service are assumed to have been made by the User and GOBUDDY shall not be held responsible for any misuse or fraudulent use of information obtained.

GOBUDDY shall not be liable for any loss or damage caused by misuse of the service which is not directly imputable to it by way of intent or gross negligence.

GOBUDDY shall not be responsible for loss or damage due to the non-performance or defective performance of the Service where this is not directly or indirectly attributable to GOBUDDY as a result of willful misconduct or gross negligence and shall not be responsible in particular for (i) errors, omissions or other inaccuracies relating to the information made available through the Service ii) damages caused by the fault of the User or third parties, including intellectual property violations, (iii) the non-fulfilment or defective fulfilment resulting from the fulfilment of judicial decisions or administrative authorities or (iv) the non-fulfilment or defective fulfilment resulting from the occurrence of force majeure situations, i.e, situations of an extraordinary or unpredictable nature external to GOBUDDY and which cannot be controlled by it, such as fire, power failure, explosion, war, riot, civil commotion, government decision, strike, earthquake, flood, natural cataclysm or other situations not controllable by GOBUDDY that prevent or hinder the fulfillment of the obligations undertaken.

GOBUDDY does not guarantee that:

  1. The Service is provided uninterruptedly, is secure, error-free or operates infinitely;
  2. The quality of any product, service, information or any other material purchased or obtained through the Service fulfils any of your expectations of it;
  3. Any material obtained in any way through the use of the Service is used at the User’s own risk and the User is solely responsible for any damage caused to its computer system and equipment or any loss of data that results from such operation;
  4. Any advice or information, whether oral or written, obtained by the User from or through the Service will create any guarantee that is not expressed in these General Conditions.

The User accepts that GOBUDDY cannot in any way be held responsible for any damages, including, but not limited to, damages for loss of profits, data, content, or any other loss (even if the User has been advised of the possibility of such damages in advance), resulting therefrom:

i) The use or impossibility of use of the Service;
ii) The difficulty in obtaining any substitute goods/services;
iii) The unauthorized access or modification to personal databases.

4. Obligations of the Consumer

The User undertakes to:

i) Provide correct personal data and address;
ii) Not use false identities;
iii) Respect the order limits imposed.

If any of the data is incorrect, i.e. insufficient, and for this reason there is a delay or impossibility in processing the order, or eventual non-delivery, the responsibility lies with the User, with GOBUDDY being exempt from any liability. In the event of the consumer breaching any of these obligations, GOBUDDY reserves the right to eliminate future purchases, block access to the shop, cancel the supply of any other services made available simultaneously by GOBUDDY to the same User; and, furthermore, not to allow the User future access to any service(s) made available by GOBUDDY.

The use of products and services acquired for commercial purposes, namely for the purpose of reselling goods, is expressly forbidden.

5. Privacy and Personal Data Protection

GOBUDDY guarantees the confidentiality of all data provided by Users.

The personal details identified in the order and registration form as being mandatory are essential for GOBUDDY. to provide the Service. Any omission or inaccuracy in the details supplied by the User is their own sole responsibility and may result inGOBUDDY.

The User’s personal data will be processed and stored electronically and are intended to be used by GOBUDDY in the context of the contractual and/or commercial relationship with the User and, where the User consents, for sending promotional communications of interest.

Under the terms of current legislation on personal data protection, Users are guaranteed the right to access, rectify, erase their personal data, oppose the use of their data, limit the processing and portability of their data, for the purposes set out in the previous paragraph, free of charge, and to do so they must send their request via the available contacts.

GOBUDDY respects your privacy and the protection of your personal data. Any and all information collected on the website will be kept confidential and not passed on to third parties without the user’s express prior consent.

The data provided by the User shall be processed exclusively in order to provide the services requested by the User and improve their experience on the website, cf. Privacy Policy and Cookies Policy.

6. Cancellation of orders

6.1 At the request of the User
The User may cancel their order by requesting GOBUDDY to do so via the platform or email quoting the order number, which will be accepted provided that the order has not yet been processed. After processing, GOBUDDY will attempt to deliver the order, but the User has the option not to accept it..

For the purposes of cancellation, the User must provide GOBUDDY with the following details:

a) Order number;
b) Tax Number with which made the order and delivery address.

6.2 By decision of GOBUDDY
GOBUDDY reserves the right not to process orders where it finds any inconsistency in the personal data submitted or observes misconduct on the part of the purchaser. GOBUDDY reserves the right not to process any order or refund in the event of errors in value and/or characteristics of products where these are due to technical problems or errors beyond GOBUDDYs control.

7. Intellectual Property

The Platform is a registered website and the Service provided by the website itself is the responsibility of GOBUDDY.

The User acknowledges that the Service contains confidential information and is protected by Copyright and Related Rights, industrial property and other applicable legislation.

The User acknowledges that any content contained in advertising, highlighting, promotion or mention of any sponsor or advertiser is protected by the laws relating to copyright and related rights, the laws relating to industrial property and other laws for the protection of property and that any use of such content may only occur under the express authorization of the respective owners.

The User undertakes to fully respect the rights referred to in the previous paragraph, in particular by refraining from any acts that may violate the law or the aforementioned rights, such as the reproduction, commercialization, transmission or making available to the public of these contents or any other unauthorized acts that have the same object.

8. Safety Conditions of the Service

The User undertakes to observe all applicable legal provisions, in particular, to refrain from committing or encouraging the practice of illegal or immoral acts, such as the indiscriminate sending of unsolicited communications (spamming) in violation of the provisions of the legislation applicable to the processing of personal data and to advertising communications through automatic calling machines, and must also observe the rules of use of the Service, under penalty of the GOBUDDY suspend or deactivate the Service.

The User expressly acknowledges and accepts that the IP Network is a public electronic communications network that may be used by several users and, as such, is subject to computer overloads and GOBUDDY therefore does not guarantee that the Service will be provided without interruptions, loss of information or delays.

GOBUDDY also does not guarantee the provision of the Service in situations of unforeseeable overload of the systems on which it is based or force majeure (situations of an extraordinary or unpredictable nature, external to GOBUDDY and which cannot be controlled).

If the Service is interrupted due to an unpredictable overload of the systems on which it is based, GOBUDDY undertakes to restore the Service as soon as possible.

9. Suspension and deactivation of the Service

Regardless of any prior or subsequent notice, GOBUDDY may at any time, in its own exclusive discretion, discontinue providing the Service and or part of the Service to any or all Users.

GOBUDDY also reserves the right to immediately suspend or end access to the Service in the following cases:

a) When the User does not observe the conditions of use referred to in point 4 and others referred to in the General Conditions;
b) When GOBUDDY ceases to provide access to the platform, subject to 15 (fifteen) days’ prior notice of such cessation.

Suspension or cessation of the Service by GOBUDDY, under the terms of the preceding paragraphs shall not entitle the User or third parties to any indemnity or other compensation and GOBUDDY shall not be responsible or in any way liable for any consequences resulting from the suspension, cancellation or termination of the Service.

In the above situations, GOBUDDYwill give the User prior notice so that they may, if they wish, safeguard the contents of their order viewing area within 3 (three) working days of the email being sent or the information being made available on the main page of the Service.

10. Promotional communications

Without prejudice to other forms of communication provided for in these General Conditions, the notifications made to the User that relate to the Service, including any changes to these General Conditions, may be made to the User’s email address, by SMS or telephone contact.

The User agrees to receive any and all communications and/or notifications related to the App, to the address, contact phone number and or electronic mail address (“e-mail”) indicated in the order process.

At any time, you can request not to receive these communications and/or notifications through the Contact Form or through the “Do not receive the Newsletter” option included in each Newsletter.

11. Technical Configurations

Without prejudice to the provisions of the following paragraph, GOBUDDY may alter the Service and/or the technical conditions of provision of the same, as well as the respective rules of use, and shall inform the User of any such alterations at least 15 (fifteen) days in advance.

The version of these General Terms and Conditions and their annexes in force at any given time is available on the website.

12. Communications

Where GOBUDDY considers it necessary or convenient to optimize the browsing experience and/or improve connectivity conditions, it may remotely reformulate the network settings.

Without prejudice to the provisions of the following paragraphs and taking into account the innovative nature of the Service and the technological developments to which it may be subject, GOBUDDY may alter its technical configurations as and when required to adapt to any technological developments.

GOBUDDY does not guarantee the User will receive any upgrades or improvements to the Service.

Some upgrades or new features of the Service may only be available against payment by the User and/or subscription by the User to Specific Conditions of use.
