2. Information and Consent

The Portuguese Data Protection Law No. 58/2019 of 8 August 2019 (hereinafter “PDPL”) and the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, hereinafter “GDPR”) ensure the protection of natural persons regarding the processing of personal data and the free movement of such data.

Under the legal terms personal data is considered to be any “information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person”.

By accepting this Privacy Policy, the user gives his informed, express, free and unequivocal consent for the personal data provided through the website to be included in a filing system under the responsibility of Buddy, Sociedade Unipessoal, Lda, which processing under the terms of the legislation on personal data protection complies with the appropriate technical and organizational security measures.

A Buddy, Sociedade Unipessoal, Lda maintains a database with the registration of its customers composed only by the personal data supplied by the data subject himself at the time of registration, which are collected and processed automatically by Buddy, Sociedade Unipessoal, Lda, ethe controller responsible for the processing of personal data.

Under no circumstances will personal data on racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, data concerning health, genetic or biometric data or data concerning sex life or sexual orientation be requested.

Under no circumstances will Buddy, Sociedade Unipessoal, Lda carry out any of the following activities with the personal data provided through this website without the express prior consent of the data subject:

• Transfer to other persons or other entities;
• Transfer outside the European Economic Area (EEA)

3. Purposes of processing personal data

The personal data processed through this page will only be used for the following purposes:

i. Registration on the platform;
ii. Management and delivery of the requested service;
iii. Management and execution of the contractual relationship;
iv. Detect and investigate fraud and possible criminal offences;
v. Communication and clarifications;
vi. Processing of information requests;
vii. Complaints processing;
viii. Statistical analysis activities;
ix. Verify, maintain and develop statistical systems and analysis;
x. Promotional communication and direct marketing.

Data created during use of our services. This includes:

• Location data (driver and delivery person): We collect precise or approximate location data from drivers’ and delivery persons’ mobile devices when the GoBuddy app is running in the foreground (app open and on-screen) or background (app open but not on-screen).
• Location data (riders and order recipients). We collect precise or approximate location information from riders’ and order recipients’ mobile devices if they enable us to do so via their device settings.

Buddy, Sociedade Unipessoal, Lda collects such data from the time a trip or order is requested until it is finished, and any time the app is running in the foreground  (app open and on-screen). Riders and order recipients may use the GoBuddy app without enabling collection of location data from their mobile devices. However, this may affect certain features in the GoBuddy app. For example, a rider who has not enabled precise location data will have to manually enter their pick-up address.

Buddy, Sociedade Unipessoal, Lda gguarantees the confidentiality of all data provided. Although Buddy, Sociedade Unipessoal, Lda collects and processes data in a secure manner that prevents its loss or manipulation, using the most appropriate techniques for this purpose, it is important to bear in mind that data collection over open networks allows personal data to circulate without security conditions, with the risk that it may be seen and used by unauthorized third parties. The lack of response to data marked as obligatory implies the impossibility to respond to the request of the data subject.

4. Security measures

Buddy, Sociedade Unipessoal, Lda declares that it has implemented and will continue to implement the security measures of a technical and organizational nature required to guarantee the security of the personal data provided to it in order to prevent their alteration, loss, processing and/or unauthorized access, taking into account the current state of technology, the nature of the data stored, and the risks to which they are exposed.

Buddy, Sociedade Unipessoal, Lda guarantees the confidentiality of the data provided through this website. The collection and treatment of data is carried out in a secure way and that prevents its loss or manipulation. All data will be inserted in a Secure Server (SSL 128 bits) that encrypts/encodes them (transforms them in a code). You can check that your browser is secure if the padlock symbol appears or if the address starts with https instead of http.

Personal data is processed with the legally required level of protection to ensure their security and prevent their alteration, loss, processing or unauthorized access, taking into account the state of technology, with the user being aware and agreeing that Internet security measures are not impregnable.

Whenever accessing personal data Buddy, Sociedade Unipessoal, Lda undertakes to:

• Store them by means of legally required security measures of a technical and organizational nature that guarantee their security, thus avoiding alteration, loss, treatment or unauthorized access, in accordance with the state of technology at each moment, the nature of the data and the possible risks to which they are exposed;
• To use the data exclusively for the purposes previously defined;
• Ensure that the data is processed only by those employees whose intervention is necessary to satisfy the request of the data subject, who are bound by the duty of secrecy and confidentiality. If the information may be revealed to third parties for the aforementioned purposes, they shall be required to maintain the necessary confidentiality in accordance with the terms of this document.

5. Commercial and promotional communications

One of the purposes for which personal data provided by users are processed is to send electronic communications with commercial and promotional information. All communications of this type will be directed exclusively at users who have given prior express consent.

If the user wishes to stop receiving commercial or promotional communications from Buddy, Sociedade Unipessoal, Lda, the user may express opposition at any time by sending an email to help@gobuddyapp.com

6. Exercise of rights

In accordance with the provisions of the PDPL and the GDPR, users may exercise their rights of information, access, rectification, erasure, restriction of processing, portability and object at any time, by means of a written request addressed to Buddy, Sociedade Unipessoal, Lda by the following means:

7. Control Authority

In legal terms, the data subject has the right to submit a complaint on personal data protection to the competent supervisory authority, the National Commission of Data Protection (CNPD) www.cnpd.pt
